LMIA申请七大因素:
1. 雇用外国工人是否有助于为加拿大人创造或保留工作?
Whether the employment of the foreign national will or is likely to result in direct job creation or job retention for Canadian citizens or PRs.
2. 雇佣外国工人能否带来技能或专业知识转移?
Whether the employment of the foreign national will or is likely to result in the development or transfer of skills and knowledge for the benefit of Canadian citizens or PRs.
3. 是否有助于填补劳动力短缺?
Whether its likely to fill a labor shortage
4. 招聘是否符合薪资标准?
Whether wages offered are consistent with the prevailing wage rate for the occupation and whether the working conditions meet generally accepted Canadian standards
5.雇主是否已经付出招聘努力?
Whether the employer will hire or train Canadian citizens or prs or has made, or has agreed to make, reasonable efforts to do so.
6.公司和/或行业是否存在持续的劳资纠纷?
Whether the employment of the foreign worker is likely to adversely affect the settlement of any labor dispute in progress or the employment of any person involved in the dispute – assessment of this factor is attestation-based
7.雇主是否履行LMIA申请的条件?
Whether the employer has fulfilled or has made reasonable efforts to fulfill any commitments made – wages, occupation, working conditions, training, etc.
LMIA 加分项目基本要求:
申请人需要满足联邦快速通道EE入池要求 LMIA申请流程:1.签约缴费,客户背景评估,制定针对性申请方案(1周)
2.收集客户和雇主信息,撰写广告文书(2周)
刊登广告,招聘(1-3个月) 收集准备申请材料,递交申请(1个月)
LMIA审理,雇主电话面试(1-3个月)
LMIA获批,申请封闭工签(2周)
工签递交移民局审理/ EE加分(1-6个月)
常见问题和解答
然而对于一些超大型的企业,为了确保这些企业能正常的运作,每年对于一些特殊企业特殊行业,雇主可以提前申请Unnamed (不记名的)Labour Market Impact Assessment,方便企业在任何时候都可以招募海外员工。
此外,如果你的加拿大公司与外国公司有母子关系,又能提供足够的证据,可以免去LMIA,把员工以内部派遣的方式招聘来加拿大。
